USPlabs Asks JPML to Consolidate Jac3d, OxyElite Actions

WASHINGTON, D.C. — USPlabs LLC has asked the Judicial Panel on Multidistrict Litigation to consolidate for pretrial purposes nine actions involving its Jac3d and OxyElite Pro supplements, asserting it “would promote convenient, consistent and efficient pretrial proceedings.”

In a Jan. 13 motion, USPlabs maintains that all of the actions assert “virtually identical allegations regarding the purportedly injury-causing products and their constituent ingredients” and “factual issues relating to a contested area of Food and Drug Administration regulatory interpretation.”
