MIAMI – A federal judge has dismissed a Florida plaintiff’s suit against Howmedica Osteonics Corp. alleging defects in an EIUS prosthetic knee device, saying claims in an amended complaint failed to meet federal pleading standards.
Judge James L. King's order dismissing the lawsuit filed by Sandra Witt was filed in the U.S. District Court for the Southern District of Florida Dec. 30. Dismissal was without prejudice, however, and Judge King gave Witt 20 days in which to submit a second amended complaint.
