BATON ROUGE, La. — A Louisiana appellate court has partially reinstated a DePuy ASR hip patient’s lawsuit against the hospital where his implant surgery was performed, saying a lower court erred in dismissing redhibition and breach of contract claims.
The Louisiana Court of Appeal, First Circuit’s Dec. 27 decision to reverse in part also affirmed the St. Tammany Parish District Court’s dismissal of detrimental reliance, however, saying that Phillip Harrison failed to offer any factual allegations that Slidell Specialty Hospital made any promises to him or that he relied on said promises to his detriment.
