HARRISBURG, Pa. – A Pennsylvania Superior Court majority has vacated a $27.6 million jury award and ordered a new trial on claims that a woman who received Zimmer’s (NYSE: ZMH) Gender Solutions Knee device suffered compensable injuries while making a promotional video for the manufacturer.
In a Dec. 20_ en banc_ decision, the Superior Court reiterated a Feb. 28 holding by a panel of the same court that the trial court in this case erred in preventing Zimmer from raising certain challenges to causation testimony offered by the plaintiffs' physician and that the errors warrant a new trial.
