NEW ORLEANS — A Louisiana federal judge has remanded a Medtronic Inc. (NYSE: MDT) defibrillator lead case to state court, finding the nondiverse medical provider defendant could be found liable under state law.
On Dec. 18, Judge Sarah S. Vance of the U.S. District Court for the Eastern District of Louisiana found that even if the Louisiana Medical Malpractice Act applies to the claims against the provider, Louisiana law might impose liability because the provider waived its right under the act to a pre-suit review before a medical review panel.
