NEW YORK — Negligence and strict liability claims brought against Bayer Corp. in connection with its contrasting agent Magnevist are time-barred under New York’s three-year statute of limitations because the plaintiff discovered her injuries seven years ago, a New York federal judge has ruled.
On Dec. 13, Judge Joseph F. Bianco of the U.S. District Court for the Eastern District of New York noted that the three-year statute of limitations is triggered when the plaintiff first notices symptoms of her injuries, rather than when the cause was diagnosed.
