Stryker Rejuvenate MDL Court Severs and Remands Claims Against ‘Misjoined’ Hospital Defendants

MINNEAPOLIS – The federal judge presiding over the Stryker Rejuvenate hip MDL has severed and remanded claims brought against in-state hospital defendants by a California plaintiff, finding that the claims do not arise from the same occurrence as product liability claims against Stryker.

The Dec. 12 ruling by Judge Donovan W. Frank of the U.S. District Court for the District of Minnesota came a motion to remand by plaintiff David Akin.

Akin, a California resident, sued Stryker Corp. and affiliates, as well as California defendants Mercy Hospital and Dignity Health, for various injuries arising from his allegedly defective Stryker Rejuvenate …
