Hip Case Removed From Pinnacle MDL Based on New Allegations in Amended Complaint

DALLAS – The DePuy Pinnacle MDL court has entered a suggestion of remand in a hip defect case brought by a New York physician based on new allegations in an amended complaint that a different device was actually implanted.

Judge Ed Kinkeade, who presides over the Pinnacle Hip Product, noted in his Dec. 5 order that the allegedly defective implant cited in plaintiff David Kaufman’s Dec. 3 amended complaint was a DePuy ASR XL Acetabular Hip System, which is not the subject of MDL 2244 pending before Judge Kinkeade in the U.S. District Court for the Northern District of Texas.
