GRAND RAPIDS, Mich. — A federal judge in Michigan has remanded a Rejuvenate hip lawsuit to state court after rejecting defense assertions that Michigan-based Stryker Corp. was fraudulently joined to defeat diversity jurisdiction.
Judge Patrick J. Duggan of the U.S. District Court for the Eastern District of Michigan issued the remand order Nov. 25, a month after he refused defendants’ motion to stay the action pending an expected transfer to the multidistrict proceedings in the District of Minnesota (In re: Stryker Rejuvenate and ABT II Hip Implant Products Liability Litigation, MDL No. 2441).
