Pa. Federal Judge Dismisses Failure-To-Warn Claim in Abilify Injury Case

SCRANTON, Pa. — A failure-to-warn claim asserted against Bristol-Myers Squibb Co. by a plaintiff who claims Abilify causes dystonia was inadequately pled and must be dismissed, a Pennsylvania federal judge has ruled.
On Dec 2, Judge Malachy E. Mannion of the U.S. District Court for the Middle District of Pennsylvania found the plaintiff failed to specify what warnings the drug maker should have provided to the plaintiff’s treating physician.
Ryan Bergstresser sued Bristol-Myers in the Lackawanna County (Pa.) Court of Common Pleas, alleging his ingestion of Abilify caused him to develop symptoms of dystonia, a neurological movement disorder.
