Plaintiffs’ Experts Qualified to Testify in Generic Reglan Case, N.C. Federal Judge Rules

GREENVILLE, N.C. — A North Carolina federal magistrate judge has limited the testimony of a plaintiff’s expert witness in a generic Reglan case, ruling that he may not suggest PLIVA USA Inc. had a duty to provide warnings other than those approved for the brand-name label.

However, in a Nov. 27 order, Magistrate Judge Kimberly Swank of the U.S. District Court for the Eastern District of North Carolina denied PLIVA’s request to exclude entirely the testimony of plaintiffs’ experts, finding they are qualified to give opinions concerning a possible link between metoclopramide and tardive dyskinesia.
