NEW ORLEANS — Stryker Corp. defendants have cited several grounds for dismissing a Louisiana couple’s Trident hip case, including the express preemption provisions of the Medical Device Amendments Act of 1976.
Stryker filed a motion to dismiss Nov. 22 in the U.S. District Court for the Eastern District of Louisiana in a case brought by Vonda and Frank Kirtley over what they say was a defective hip device implanted in August 2003.
The Kirtleys allege that Vonda underwent a total left hip replacement on Aug. 3, 2003, receiving what they describe as a Stryker “Accolade System.” Vonda Kirtley says that …
