NASHVILLE, Tenn. — A personal injury suit brought against General Electric (NYSE: GE) in connection with its Omniscan contrast agent is barred by the statute of repose in the Tennessee Products Liability Act because it was filed four years after the product’s expiration date, a Tennessee federal judge has ruled.
On Nov. 14, Judge Aleta A. Trauger of the U.S. District Court for the Middle District of Tennessee found Tennessee, rather than New Jersey, law applies because Tennessee has the most significant relationship with the facts of the case.
