CHICAGO — The judge presiding over the federal NexGen Knee MDL has denied Zimmer Inc.’s request to bar some plaintiffs’ experts from gaining access to documents that might provide information on a new knee device, but the court has suggested its own confidentiality language to resolve the parties’ discovery impasse.
Judge Rebecca R. Pallmeyer entered an order Nov. 14 in the U.S. District Court for the Northern District of Illinois denying Zimmer’s motion for a Supplemental Confidentiality Order, while also denying plaintiffs’ motion to strike the supporting affidavit of Zimmer Director of Knee Development Brian Earl.
