Magistrate Judge Addresses Objections to Subpoenas Served in Compounding Pharmacy MDL

BOSTON —A federal magistrate judge in the New England Compounding Pharmacy Inc. multidistrict litigation has quashed subpoenas served to hospitals and clinics that are not on the Food and Drug Administration’s list of entities receiving NECC products.

On Nov. 13, Magistrate Judge Jennifer C. Boal of the U.S. District Court for the District of Massachusetts also quashed subpoenas sent to hospitals and clinics who have no patients who have filed suit, joined in the MDL, or given notice of a claim against any party relating to the medications at issue.
