Pelvic Mesh Case Timely Removed to Federal Court, W. Va. Federal Judge Rules

CHARLESTON, W. Va. — A pelvic mesh injury case was timely removed to federal court because the 30-day removal period did not begin until the defendants were formally served, a West Virginia federal judge has ruled.

On Nov. 13, Judge Joseph R. Goodwin of the U.S. District Court for the Southern District of West Virginia denied the plaintiff’s request for remand of the case to state court.

According to the suit, in July 2008, Elizabeth Dynes underwent surgery for vaginal vault prolapse, enterocele, and stress urinary incontinence. She was implanted with an AMS Monarc Subfascial Hammock. Dynes alleges that the …
