MINNEAPOLIS — Stryker Corp. contends in a brief opposing remand of a Rejuvenate hip case that the plaintiff has improperly joined local hospital defendants to deprive the federal courts of jurisdiction but cannot assert any viable claims against them.
Judge Donovan W. Frank of the U.S. District Court for the District of Minnesota has scheduled argument on plaintiff David Akin’s remand motion for Nov. 21 following the next scheduled conference in the consolidated Stryker Rejuvenate proceedings (In re: Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation, MDL No. 2441).
