Stryker Pain Pump Action Time-Barred Under Virginia Law, Federal Judge Rules

ABINGDON, Va. — Virginia, rather than District of Columbia, law applies to claims brought against Stryker Corp. and Stryker Sales Corp. (NYSE:SYK) in connection with their pain pump, therefore the claims are time-barred under Virginia’s statute of limitations, a Virginia federal judge has ruled.
On Oct. 30, Judge James P. Jones of the U.S. District Court for the Western District of Virginia found Stryker lacks continuous and systematic contacts with the District of Columbia; therefore the statute of limitations cannot be tolled by the district’s discovery rule, which Virginia has not adopted.
