NEW ORLEANS — A federal judge has rejected Zimmer Inc.’s motion for summary judgment in a Louisiana hip implant case, ruling that the issue of whether there was unreasonable delay in filing suit should be left to the factfinder.
U.S. District Judge Jay C. Zainey’s Oct. 10 order denied Zimmer’s request that the court find that plaintiff Philip Frank filed suit outside Louisiana’s one-year limitations period for product liability claims.
