LOUISVILLE, Ky. — After ruling that a Mirena complaint brought against Bayer Pharmaceuticals Corp. was inadequately pled because it did not contain the requisite factual detail, a Kentucky federal judge allowed the plaintiffs to file an amended complaint.
On Oct. 16, Judge Joseph H. McKinley Jr. of the U.S. District Court for the Western District of Kentucky referred to 6th Circuit case law stating that leave to amend is appropriate in some cases, even in absence of a motion to amend.
