Nev. Judge Remands Pradaxa Action; Finds Sales Rep Was Not Fraudulently Joined

ST. LOUIS — An Illinois federal judge has remanded a Pradaxa suit to state court, finding the nondiverse defendant, a Boehringer Ingelheim Pharmaceuticals Inc. sales representative, was not fraudulently joined.
On Oct. 11, Chief Judge David R. Herndon of the U.S. District Court for the Southern District of Illinois explained that Nevada courts have not conclusively decided whether sales representatives may be subject to liability.
Kathryn Zaite, individually and as administratrix of the estate of Irma Toth, sued BIPI in the Clark County (Nev.) District Court, alleging Toth was injured by her ingestion of Pradaxa. The suit also named BIPI …
