Mich. Federal Judge Denies Stryker’s Motion to Stay Rejuvenate Hip Case Pending Expected Transfer to MDL

GRAND RAPIDS, Mich. — A Michigan federal judge has denied a stay sought by Howmedica Osteonics in a Rejuvenate hip case, saying that asking the MDL court to decide the jurisdictional questions raised by the in-state citizenship of defendant Stryker would not promote judicial economy.
Judge Patrick J. Duggan noted in his Oct. 15 order that the jurisdictional issues have been fully briefed in the plaintiffs’ motion for remand pending in the U.S. District Court for the Eastern District of Michigan.
