Judge Says Stryker Corp.’s Bid to Supplement Claims Against Insurer XLIA ‘Futile’

GRAND RAPIDS, Mich. — A federal magistrate judge has granted Stryker Corp.’s motion to supplement its knee implant coverage claims against TIG Insurance Co., but denied the motion with respect to XL Insurance America, saying that coverage has been exhausted.
Magistrate Judge Joseph G. Scoville entered the order in the U.S. District Court for the Western District of Michigan on Oct. 7.
The magistrate judge’s opinion on Stryker’s motion to amend its complaint to add breach of contract and promissory estoppel claims is the latest in a case “with a long and tortured history,” according to the magistrate judge.
