BENTON, Ill. — A federal judge in Illinois has declined jurisdiction of a Biomet M2a Magnum hip implant lawsuit and transferred it to the U.S. District Court for the Western District of Pennsylvania, where the plaintiff’s surgery was performed.
Judge J. Phil Gilbert concluded Oct. 7 that the Southern District of Illinois has no connection to the claims brought by John J. Flaherty against Biomet Orthopedics LLC.
Judge Gilbert rejected the argument that a transfer to Pennsylvania, where Flaherty’s surgery took place, was inefficient because the case will eventually be transferred to the federal MDL pending in the Northern District …
