NEW ORLEANS — A Louisiana judge has refused to dismiss Louisiana Products Liability Act claims brought against Bayer Healthcare Pharmaceuticals Inc. in connection with its Mirena intrauterine birth control device, finding they may be timely.
On Sept. 23, Judge Jay C. Zainey of the U.S. District Court for the Eastern District of Louisiana held that new facts set forth in the plaintiffs’ affidavit create an issue of fact as to whether the claims are timely under Louisiana law.
