Judge Grants Abbott Summary Judgment in Humira Case After Excluding Plaintiff’s Expert Testimony

BOSTON — A Massachusetts federal judge has granted Abbott Laboratories (NYSE: ABT) summary judgment in a Humira case, finding the plaintiff failed to produce admissible evidence in support of her claim that the drug maker failed to adequately warn of the risk of lymphoma.
On Sept. 27, Judge Denise J. Casper of the U.S. District Court for the District of Massachusetts found the plaintiff’s only expert testimony must be excluded because the expert is not qualified to opine as to the adequacy of Humira’s label.
