CHICAGO — A plaintiff’s expert in a Triathlon knee implant injury case may testify as to her theory that a dimensional mismatch of two of the device’s components rendered it defective, a federal judge has ruled.
In denying defendant Howmedica Osteonics Corp.’s motion for summary judgment in part, Judge William T. Hart of the U.S. District Court for the Northern District of Illinois also ruled Sept. 24 that the biomedical engineering expert may not blame plaintiff Ronald Berman’s alleged injury on the manufacturer’s substandard quality control practices without additional foundation for the opinion.
