Judge Denies Class Certification For Plaintiffs Asserting Economic Injury Claims





SEATTLE-Plaintiffs involved in six separate PPA products liability cases were denied class certification for the establishment of two nationwide subclasses designed for consumers asserting economic injury claims, a federal judge ruled. In re: PPA Products Liability Litigation, MDL-1407 (W.D. Wash.).

U.S. District Judge Barbara Rothstein determined that the plaintiff's request did not satisfy the requirements of Rule 23(b)(3), which states that in order to obtain class status, the plaintiffs must prove that common issues of law predominate over individual questions.
