KANSAS CITY, Mo. - A Missouri federal judge has rejected KLS Martin’s efforts to overturn an $850,000 plaintiffs’ verdict issued in a mandibular distraction device case, ruling that the expert testimony and evidence supported the jury’s findings and the damages award.

Senior Judge Ortrie D. Smith of the U.S. District Court for the Western District of Missouri found the testimony supported the design defect and failure-to-warn claims and that the patient’s additional hospitalization, pain and suffering resulting from the breaking of the device justified the damages award.
