KANSAS CITY, Mo. - A Missouri federal judge has remanded a transvaginal mesh case to state court after rejecting Boston Scientific Corp.’s (NYSE: BSX) argument that the matter constitutes a “mass action” as defined by the Class Action Fairness Act.
On Aug. 27, Judge Carol E. Jackson of the U.S. District Court for the Eastern District of Missouri found the plaintiffs do not seek consolidation of the case with two similar mesh cases pending against Boston Scientific; rather, they merely seek assignment of a single judge to guide the cases through pretrial and trial.
