SHREVEPORT, La. — A Louisiana federal judge has dismissed a Dilantin injury case against Pfizer (NYSE: PFE), finding the claims falling within the Louisiana Products Liability Act were insufficiently pled, and the remaining product liability claims fall outside of the act.
On Aug. 28, Judge S. Maurice Hicks Jr. of the U.S. District Court for the Western District of Louisiana found the plaintiff fails to explain how the drug deviated from its intended composition and did not articulate a causal connection between the allegedly inadequate warning and the resulting damage.
