Pa. Federal Judge Transfers Paxil Birth Defect Case to Minnesota

PHILADELPHIA — A Pennsylvania federal judge has transferred a Paxil birth defect action to Minnesota, finding the private and public factors “overwhelmingly” weigh in favor of transfer because the plaintiffs incurred their alleged injuries in Minnesota and were treated in that state.
On Aug. 14, Judge Harvey Bartle III of the U.S. District Court for the Eastern District of Pennsylvania added that that transfer to Minnesota is more convenient for the parties because plaintiffs reside there.
