CHARLESTON, W. Va. - In the first federal C.R. Bard Inc. Avaulta pelvic mesh case to go to trial, a West Virginia jury on Aug. 15 awarded plaintiff Donna Cisson $2 million on her design defect and failure to warn claims.
At the conclusion of the trial presided over by Judge Joseph R. Goodwin of the U.S. District Court for the Southern District of West Virgina, the jury awarded Cisson $250,000 in compensatory damages and $1.75 million in punitive damages. Cisson’s husband was awarded nothing on his loss of consortium claim.
