Mo. Appeals Court Refuses to Disturb Allocation of Chemotherapy Dilution Settlement

KANSAS CITY, Mo. — A Missouri appeals court has refused to vacate a trial court’s approval of the allocation of funds from a settlement of claims against two drug makers in connection with a pharmacist’s scheme to dilute chemotherapy drugs.

On Aug. 13, the Missouri Court of Appeals, Western District, ruled that the claimants did not invoke the appropriate mechanism to set aside the settlement agreement. The court also rejected their challenge of the trial court’s refusal to unseal the record, noting the settlement was confidential.
