Florida’s 4-Year Statute of Limitations Applies to Zometa Case, Federal Judge Rules

TAMPA, Fla. — Florida, rather than Georgia, law applies to a Zometa injury action, therefore the claims are not time-barred under Florida’s four-year statute of limitations, a federal judge has ruled.
On July 31, Judge Gregory A. Presnell of the U.S. District Court for the Middle District of Florida found that Florida has the most significant contacts to this action. The plaintiff’s injury was diagnosed in Florida and her cause of action accrued in Florida when she first learned that Zometa was the likely cause of her osteonecrosis of the jaw.
