SAN FRANCISCO — A plaintiff whose hip implant case has been assigned to the coordinated DePuy ASR proceedings in San Francisco Superior Court is opposing a motion by Biomet to separate and remand claims based on alleged defects in its products to another trial court.
Plaintiff Denny E. Martin, who alleges failures in hip devices made by both DePuy Orthopaedics Inc. and Biomet, submitted his opposition July 15 to Biomet’s motion to remand, saying the issue of the division of claims was previously addressed and rejected by a federal court.
