BOSTON — A federal judge has dismissed without prejudice a lawsuit alleging that Stryker Corp. (NYSE: SYK) and Howmedica Osteonics Corp. engaged in deceptive acts in the manufacture, design and marketing of the Accolade hip replacement device, leading to the death of a recipient during revision surgery.
Judge Patti B. Saris of the U.S. District Court for the District of Massachusetts issued her ruling July 17, although she noted that the plaintiff, who represents the implant recipient’s estate, failed to appear at a July 10 hearing to oppose Stryker’s motion.
