Zimmer Settles Suit Over Knee Implant Royalties Claimed by Surgeon Norman Scott

INDIANAPOLIS — Zimmer Inc. (NYSE: ZMH) has settled a declaratory judgment challenging more than $3 million in royalties awarded New York surgeon W. Norman Scott, M.D. for his part in developing the company’s knee implant technologies.
Zimmer and Scott filed a Joint Stipulation July 12 in the U.S. District Court for the U.S. District Court for the Northern District of Indiana, notifying the court that they have settled the litigation. Terms were not disclosed.
Disputes between the parties first arose in 2004 when Scott challenged Zimmer’s computations for royalties for a “NextGen Knee System” and a “Mobile Bearing Knee.” That …
