CHARLESTON, W. Va. – The judge overseeing the C.R. Bard Inc. pelvic repair system multidistrict litigation has denied plaintiff Carolyn Jones’s motion to remove her case from the Group One bellwether trial pool for additional discovery.
In the July 9 order, Judge Joseph R. Goodwin of the U.S. District Court for the Southern District of West Virginia explained that if he were to remove cases from the trial pools due to a need for additional discovery because of ongoing complications, “the potential arises for the parties to manipulate which cases go to trial and which do not.”
