DePuy ASR MDL Substitutes Understudy for 1st Bellwether Trial in September

TOLEDO, Ohio — A case brought on behalf of a Rochester, N.Y., plaintiff will be the first to be tried in the DePuy ASR multidistrict proceedings, according to the MDL court’s latest scheduling order.
Judge David A. Katz of the U.S. District Court for the Northern District of Ohio filed an order July 8, scheduling McCracken v. DePuy (1:11-cp-20485) as the first bellwether trial, with an opening date of Sept. 9. The case will be tried in the Carl B. Stokes federal courthouse in Cleveland.
The order also vacated a Sept. 9 trial date for Dorney-Madgitz v. DePuy (1:11-dp-20112), which …
