Fla. Judge Finds Stryker Trident Hip Claims Preempted, But Allows Plaintiff to Re-Plead Parallel State Claim

TAMPA, Fla. — A federal judge has dismissed a Stryker Orthopaedics Corp. (NYSE: SYK) Trident hip replacement lawsuit on federal preemption grounds, but granted leave for the plaintiff to file a second amended complaint to plead a viable parallel state-law claim.

Judge James S. Moody Jr.’s June 19 order gave plaintiff Paul E. Lederman 14 days in which to re-file and said the case would be closed without notice if that deadline is not met.
