CHICAGO — A federal judge has denied a motion by Smith & Nephew (NYSE: SNN) to dismiss a hip implant suit for failure to state a claim, finding that the allegations presented in the complaint meet minimum pleading requirements.
That ruling came June 18 from Judge Virginia M. Kendall of the U.S. District Court for the Northern District of Illinois on the two-count complaint by Richard Vosberg.
Vosberg filed his suit against Smith & Nephew in the District Court on Feb. 28, alleging that a right hip implant he received in 2008 caused pain and discomfort and released metal particles …
