CHARLESTON, W. Va. – A West Virginia magistrate judge has reopened discovery in the C.R. Bard Inc. pelvic repair multidistrict litigation to allow plaintiffs to question a C.R. Bard executive as to the company’s alleged use of a prohibited raw polypropylene resin in its mesh products.
On May 2, Magistrate Judge Cheryl A. Eifert of the U.S. District Court for the Southern District of West Virginia found the “sheer volume of the production” had prevented plaintiffs from earlier discovering the executive’s communications concerning the resin.
