BIRMINGHAM, Ala. — The plaintiff in a generic Ambien case has been ordered by an Alabama federal judge to replead his failure-to-warn and fraudulent concealment claims against Sanofi Aventis U.S. LLC (NYSE: SNY) as one count under the Indiana Product Liability Act.
On April 30, Judge Virginia E. Hopkins of the U.S. District Court for the Northern District of Alabama explained that Indiana law applies to the claims under the doctrine of lex loci delicti because the plaintiff was allegedly injured in that state.
