DePuy Says JNOV or New Trial Warranted for ‘Plainly Inconsistent’ Jury Verdicts

LOS ANGELES — DePuy Orthopaedics Inc. (NYSE: JNJ) contends in a motion to overturn an $8.26 million judgment in an ASR hip case that the jury’s findings on design defect and failure to warn were inconsistent and warrant judgment notwithstanding the verdict for defendants or a new trial.
DePuy submitted its motion for JNOV April 17 in the company’s bid to persuade the Los Angeles Superior Court to vacate a March 8 verdict and March 22 judgment. The defendant also submitted notice that it would move, alternatively, for a new trial.
