PHILADELPHIA — A Pennsylvania federal judge has denied plaintiffs’ motion to remand to state court a medical monitoring case involving C.R. Bard Inc.’s (NYSE: BCR) vena cava filters, ruling that an injury-in-fact exists once a plaintiff has a potentially defective medical device implanted.

On April 26, Judge Gene E. K. Pratter of the U.S. District Court for the Eastern District of Pennsylvania rejected plaintiffs’ assertion that they did not allege an injury-in-fact under federal law.
