Plaintiffs in Federal Lipitor Actions Ask JPML to Consolidate, Transfer Suits

WASHINGTON, D.C. — Plaintiffs in three federal Lipitor injury cases have asked the Judicial Panel on Multidistrict Litigation to consolidate all federal actions filed against Pfizer Inc. in connection with the cholesterol drug for coordinated or consolidated pretrial proceedings.
In an April 26 motion, the movants assert that the actions are appropriate for transfer and pretrial coordination under 28 U.S.C. Section 1407 because they involve common questions of fact, including whether Pfizer knew or should have known of the link between Lipitor and diabetes and whether the drug maker sufficiently warned doctors and patients of that risk.
