Judge Orders Disclosure of Former Zimmer Distributor’s Custodial File to NexGen MDL Plaintiffs

CHICAGO — Judge Rebecca R. Pallmeyer has ordered Zimmer Inc. (NYSE: ZMH) to produce the custodial file of its current president of Americas Sales as sought by plaintiffs in the NexGen Knee implant multidistrict proceedings.

The judge issued an order April 19 granting plaintiff’s motion to compel the production of files in the custody of Joseph Cucolo, who was the owner and operator of an independent northeast distributor for Zimmer before jointing the company in September.

The order applies to Cucolo’s “Zimmer New England” file, the judge specified.
