CHARLESTON, W. Va. — A West Virginia federal judge has denied plaintiffs’ motion to remand a pelvic mesh device case to California state court, finding the claims against the nondiverse healthcare defendants fail because they do not relate to professional services but rather to the allegedly defective product.
On April 10, Judge Joseph R. Goodwin of the U.S. District Court for the Southern District of West Virginia explained that plaintiffs did not allege that the treatment the plaintiff received fell below the standard of care in the medical community.
