MINNEAPOLIS — A Minnesota federal judge has sent a pain pump injury case to trial after finding questions of fact as to whether Stryker Corp. (NYSE: SYK) complied with its duty to warn of risks "which it could discover through the exercise of reasonable care."
On March 25, Judge John R. Tunheim of the U.S. District Court for the District of Minnesota found the plaintiff presented evidence that could allow a jury to find Stryker would have been aware of the risk of cartilage damage presented by intra-articular pain pump use had it exercised reasonable care.
